The relevance of the research problem is due to the need for theoretical justification for determining the structure of the principles of legal responsibility. The purpose of the article is to clarify the structure of the principles of legal responsibility in Ukraine. The leading methodological approach of the research is the structural-functional approach, which allows to consider the principles of legal responsibility as elements of the normative part of the legal system, which have their own functional purpose. Ambiguous interpretation of the concept of gender equality has caused problems in understanding and legal support of the concept of gender. This and the global democratic process contribute to the relevance of the issue and generate the need for its thorough study. The article aims to define the essence of the concept “gender,” analyze the legal support of gender policy, and develop proposals for its improvement in Ukraine. In the study, we applied theoretical (analysis, synthesis, generalization, systematization) and empirical (observation) (...) methods. The article also uses methods of statistical and comparative analysis, extrapolation, dialectical method, etc. We analyzed the content of gender policy and its consequences and identified the features of its legal support and impact on society. To replace the concepts of gender, gender equality, and its derivatives with “equality of rights of men and women” proved expedient. Proposals for improving the legal support of gender policy in Ukraine were developed. The article has a multidisciplinary nature and will appeal to a broad readership from lawyers to psychologists to raise awareness and competence in this area. (shrink)

The relevance of the study lies in the fact that in the reforms of the system of compulsory enforcement of decisions stipulated the possibility of performing these functions by private enforcers. The purpose of the article is to consider problematic aspects of the legal status of a private enforcer as a participant of legal relations in the enforcement process. The results of the study contain generalizations on the analysis of the legal status of a private enforcer, proposals for amendments to (...) current legislation on private enforcers and the protection of the rights of the parties of enforcement proceedings. Finally, conclusions were formulated, which may be useful to practitioners of various legal professions such private enforcers, lawyers, judges, as well as citizens and legal persons, including those who are parties to the executive procedure. The study focuses on the translatability of EU terminology into Ukrainian, with a specific emphasis on the term ‘regulation’. It explores the challenges and considerations involved in translating legal terms, particularly within the context of EU legislative acts. The concept of translatability potential is substantiated in the article. It is seen as language pair-dependent, influenced by the availability of similar legal concepts in the target law system, equivalent terms in the target language, and other factors. The research delves into the (...) levels of translatability potential of legal terms, taking into consideration the existence of identical concepts in the target legal system, the mono- or polysemic semantic structure of the source term, and the established translation practices accepted by legal professionals. Based on these criteria, legal terms are classified into categories of high, upper-medium, lower-medium, and low translatability potentials. The article applies these criteria to analyse the translatability potential of the term ‘EU regulation’ in Ukrainian legal discourse. The distinction between legal terms and legal concepts are highlighted, and the concepts are considered to be mental representations associated with linguistic units. The corpus method and concept analysis are employed to analyse the impact of the context on the actualisation of specific components of semantic structure and, correspondingly, specific concepts. The use of the terms in ordinary and legal discourse is under analysis, as well as different Ukrainian translations of ‘regulation’ for each concept it manifests. Finally, the semantic structures of the term ‘EU regulation’ and its Ukrainian translation ‘peглaмeнт (rehlament)’ are compared to reveal the semantic shifts caused by translation. The concept and semantic analyses are conducted to explore the realisation of the translatability potential and see if the best option provided by the potential of the term was selected to meet the high requirements of legal translation. In the study, the phenomenon of academic plagiarism is considered a result of creative scientific activity, which exists in a certain institutional design and is immersed in the appropriate environment and economic, socio-political circumstances. The study uses philosophical principles as a method—humanistic, historical, comprehensiveness and determinism, system and practice, specificity and activity. The historical retrospective shows that theft and misappropriation of other people’s intellectual property existed already in ancient societies. This article deals with the poetry of two prominent writers: Ukrainian poetess Lesia Ukrainka and Chinese poetess Qiu Jin. The diversity of wide fields of self-expression of both poetesses created the grounds for a broad and comprehensive comparison in terms of poetic, thematic, and literary similarities. The article provides a background to the translations of Lesia Ukrainka in China and accounts for the perception of Lesia Ukrainka’s poetry in China in the light of the poetic world of Qiu Jin. The article is devoted to the analysis of representations of the state which were part of the philosophical concept of the famous Ukrainian church leader, educator, philologist Yepyfanii Slavynetskyi. It was found that the historical and cultural context in which these views were formed, included deep familiarity with European philosophy, the theory of the state developed by the Orthodox intellectuals of Kyiv-Mohyla Collegium, the political struggle for the incipience of early modern Ukrainian nation in the second half of the XVII (...) century. Noted significant influence of the philosophy of E. Slavynetskyi on the religious, cultural and educational processes in Muscovy in era of Patriarch Nikon's reforms. The presence of the Patriarch own notions of state authority actively influence on the formation of the E. Slavinetsky's concept too. It is noted that E. Slavynetskyi's statesmanship theory was based on the developed by the Ukrainian Orthodox intellectuals of the end of XVI - first half XVII theory of the ideal state, which in the second half of the XVII century actively evolved due to the political union of the The Cossack Hetmanate and Moscow. Accordingly, E. Slavynetskyi recognized people's right to political activity and state power, the church was considered as a leader of social progress, obligement of the lord to care for the public good. It was found that the concept of E. Slavynetskyi's state have many elements of European theories of enlightened absolutism. Yes, he acknowledges that the foundation of the state is public good and providing the best way for implementation this good - monarchy, insisted on the absolute power of the monarch. The relationship between the church and secular authorities philosopher solves unambiguously in favor of a secular, acknowledging the king's right to decide all important issues of church life. It is noted that the main reason for the evolution of such ideas was given the fact of The Cossack Hetmanate's political union with Russia as the civilizational mission to improve the capacity of the Orthodox culture and building a just state. This theory has become its logical conclusion later in the XVIII century in F. Prokopovich's philosophical views and political activities. (shrink)

A characteristic feature of the contemporary post-industrial society is the constantly evolving new knowledge. Globalization processes and comprehensive digitalization affect the economic behavior of all economic entities and should be taken into account in the formation of strategies for their development. The driving force of progress in Contemporary conditions is closely related to the development of the abilities of a person, whose interests and needs (...) are becoming one level higher. New transformation processes require enterprises to carry out balanced investment activities, research markets, competitors, suppliers, and conduct an effective marketing policy. Businesses need to implement planning taking into account the prospects for its development. The enterprise development strategy should be long-term and contain a flexible plan of action in the direction of innovation based on a detailed analysis of the internal and external environment of the enterprise, available resources and potential of the enterprise. For the successful functioning of the enterprise, the objective necessity is the assessment of its competitiveness, which is based on identifying the strengths and weaknesses of the enterprise for its maximum improvement and finding hidden opportunities for development. The implementation of the development strategy requires efficient investments and optimal use of available resources to achieve the planned results. The author reappraises the legacy of Soviet philosopher of language Yuri Lotman and of his Tart—Moscow Semiotic School. She argues that he was neither a dissident nor a servant of the regime, and that he always remained a structuralist.

У статті проаналізовані основні підходи сучасної християнської теології до проблеми спілкування. Обґрунтована її догматична специфіка та неможливість редукції до секулярних концепцій комунікації. Автор доходить висновку, що основою християнського концепту спілкування є тринітарний догмат, який закладає парадигму спів-буття іпостасей Бога в собі; Бога та людини; людини та людини одна з одною через Бога; Бога і християнської спільнотності людей.

In this article the causes and features of a shift from neurosis to narcissism and then autism were investigated. Moreover, special attention is paid not so much to the psychological or even psychiatric aspects of the problem, but to changes in the general features of a human being. Thus, when speaking of the transition from narcissism to autism, one is focusing on true autism, which is characterized by veracity, sincerity and authencity, which reveal themselves in the form of a special (...) kind of infantility, a kind of mature infantility. A suitable example of such infantility is found in the animated film Shrek, a certain barbarism of which is not so ironic or even knowing ironic, but to a greater extent it is warm, earnest and serious although childish. Among other infantile practices, it is worth noting the situationalist-lettrist practice of organizing a text in the form of an ABC alphabet book, a hornbook, which is actualized in a digimodern context. True autism and to some extent pseudoautism in a certain sense become a way to cope with the trance and amnesia of pseudomodernism and leave a hope for the future. Thus, paradoxically, wholeness that was lost is restored through desocialization and sociopathy. This article also draws parallels between digimodernism and speculative realism, conceptualization of interpassivity as well as automodernity. It is emphasized that personal autonomy and automation can be achieved through the use of devices as a means of achieving productive loneliness, which should be distinguished from alienation. In this case, the widespread use of sensory experience as a way of communication is especially important, as an example of which Hope Sandoval’s mode of being and work are considered. It suggests that the high-tech / high-touch approach is best released in DIY activities. The above considerations allow to conclude that true autism is one of the most actual post-postmodern modes of subjectivation. (shrink)

In this article posthumanistic aspects of the problem of secret s/pace, i. e. both spaces and place were researched. Differentiation of a space and a place, a secret and a mystery was made. A manifold of a conception of secrecy from a tendency to keep a secret of s/pace carefully to claim to demystify a place completely is investigated. Philosophy, philosophical anthropology especially, appears as geophilosophy, human geography in this case. Thus a conceptualizing human being is surveying in a friendship (...) with a landscape, s/pace. The importance of natural elements for secret s/pace has been demonstrated. Of particular actuality to this study is the appeal to the current concept of the atmosphere, which is weakly perceptible, but is influential. The relationship between a secret s/pace and a secret self, such as a freak, Secret Santa, etc., was traced. A distinction is made between a secret s/pace and a non-place like moving place with a discourse, place of surveying. The importance of a secret s/pace for the formation of a post-body in a situation where the body as such is lost is shown. The importance of psychoanalytic and psychogeographic conceptualization of a secret s/pace is also demonstrated. They are adjoined by the consideration of space concerning boredom as stabilization of pleasure in the habitual and comfortable, good banality, a bliss from the side of pleasure. The significance of the secret s/pace is asserted in conditions when the city plays not only a conjunctive, connecting, but also a disjunctive, disconnecting role. A conclusion is made about a secret s/pace as a posthuman place of a place, a place-without-place with a secret of mystery. The study was carried out on the material of actual culture, as well as life practices. This corresponds to the Deleuzian statement about the intersection of concept, prospectus and affect. The study also involved speculative realism, speculative posthumanism, and other related conceptions. (shrink)

This article considers the state of human beings in a post-postmodern conditions and focuses on obversion as one version of posthuman reality in polyversion, which is lusciousness. Obversion is regarded as a logical and at the same time dynamic figure of dis-identity and non-presence. Trying to find out if a real human being is written leads one to consider the relationship of real and written reality and the possibility of posthuman writing. Posthuman writing becomes apparent in tracks, traces, scars and (...) vestiges such an @ as a signifier of becoming t@iled. The vestiges of a human being are being investigated through the appeal to an actual post-postmodern conceptions such as speculative realism, speculative posthumanism, dark ecology, etc. In the post-postmodern context concepts such as trut/h, faith and kindness as a counterweight to the excessive postmodern quotation and theorization are being examined. Thus, a human being as a post-postscript is becoming a preface at the same time. This article explores such crucial postmodern issues as iterability, signature and others in a contingent context, in which an immanence of living itself becomes a writing in the postdigitality, post-Internet and post-media extent in relation to the realization of the disaster of technical or even mechanical as human. This research realizes on a showcase of post-postmodern architecture as an immanent spatiotemporal contingency, en-vironment of a human being. It shows how a minimalistic style in post-postmodern ethics and aesthetics correlates with obversive rocking in contrast to binary opposition logic. Thus, it realizes a movement from human to posthuman as scriptor, writing a postscript, and beyond to post-posthuman as postscriptor, writing a post-postscript as a human being, writing itself in its contingent immanence. The article analyzes the problems of unknowability and total unity in the light of philosophy of Semyon L. Frank, set forth by him in the work The Unknowable. The author of the paper considers all the problems that arise as “icebergs” and tries to find the reasons for the distortion of the vision of the “top of the iceberg” and the “underwater part of the iceberg,” which is often unaware. The author examines the problems of the inadequate perception of reality: (...) a narrow “one’s own little world” of the world perception, passed off as the truth in the final instance; absolutization of the mind, which considers itself able to know everything; the cultivation of negative information and cruelty in society; the role of media forming world perception; antagonistic dichotomy of the world perception; lack of a sense of connection of everything that exists, in particular of a sense of unity of “I” and “Thou;” loss of the “culture of heart” and the ability to love. As a result of the analysis undertaken, the author concludes that only by changing the causes that give rise to the “world of evil and separation” can the lost integrity and harmony of man, society and world civilization be restored. The revival of the earth’s civilization is possible only in total unity. (shrink)

In this article human-posthuman ruptures and disconnections both in comprehension and in practices, as well as the possibility of epistemological contingency contemporaneously are investigated. This means that an epistemological ruptures and an ontological disconnections of sexuality both differ from one another, and also join together. Since ancient times both sensitive and sensible practices of sexuality were considered the best mode to concern to sexual care of self. It has shown that, in relation to sexuality, a correlation of epistemological discontinuity and (...) continuity is possible. Sexuality, which is actualized with the help of both natural, vital and death, annihilative drives, fits into the context of onticology as a posthuman ontology. Being connected with the thermodynamics of infinitesimal vital parts, anonymous strange strangers, singularities, it turns out to be especially awesome. Such a mode of sexuality is not necessarily reproductive; rather, it unfolds in the fluid space of non-presence and at the same time determines this space. It emphasizes that that the cos mo‑illogical becoming of posthuman leads to negentropy or extropy as vitality. Following this position, the foucaultian conception of the care of self mirrors lacanian graphs of sexuation in a context of object-oriented ontologies in comparison with philosophies of presence. It is recognized that this is the sexuality of the productive disconnection and the pleasure cosmic dissolution. This article concludes by illustrating that the mode of sexuality of Speculative Posthumanism is contingent with the Libidinal Materialism or Vital Posthumanism in a context in which the sexuality of Wide Human Descendants is thought to be oriented to that which is pleasure and is differentiated. B a c k g r o u n d. Deng Xiaoping is considered the main architect of socialist reforms and the founder of China's modernization theory. He mastered and developed the socialist system, trying to adjust it to the national conditions of China. Deng Xiaoping believed that it was by following the course of "socialism with Chinese characteristics" that China would transform from a poor country into a highly developed one. The article provides a theoretical reconstruction of the main (...) content of Deng Xiaoping's concept of "socialism with Chinese characteristics." The main philosophical and socio-political aspects of the concept of building socialism with Chinese characteristics are presented in a systematic form in the context of the foundations of Chineseization of Marxism. M e t h o d s. In the article, a historical-logical approach was used to reveal the specified research topic, which allowed us to determine the socio-political prerequisites for the emergence of Chineseized Marxism. An interdisciplinary approach made it possible to carry out a theoretical analysis of social, economic, and political changes in modern China, which were caused by the proposed theory of Deng Xiaoping's "socialism with Chinese characteristics". Systemic, structural-functional, and constructivist methods, as well as methods of synthesis and generalization, were also applied. R e s u l t s. Because of the above, the purpose of this study was to carry out a theoretical reconstruction of Deng Xiaoping's theory of building "socialism with Chinese characteristics" and to find out how his ideas influenced the development of modern China after the completion of the "Great Leap Forward" and the "Cultural Revolution" of Mao Zedong. The key features of Deng Xiaoping's proposed theory of "socialism with Chinese characteristics" were established, including the idea of democratization of society and implementation of the legal basis of state functioning; the beginning of a new period of "reforms and openness"; determining the course for socialist modernization; following Marxism-Leninism and the ideas of Mao Zedong. C o n c l u s i o n s. In conclusion, it can be noted that the main feature of Deng Xiaoping's ideas was that they were inextricably linked with the national and cultural traditions of Chinese civilization, starting from Confucianism and the gradual synthesis with Marxist ideology. Evaluating the theory of Deng Xiaoping, it can be defined as a relatively complete scientific system that covers the fields of philosophy, political economy, and scientific socialism, it contains the doctrine of socialist ideology, and the doctrine of the essence and ways of socialist development, theories of the reform of socialist political and economic systems, the theory of building a socialist country. The article deals with the means of constructing a naturalistic character, the model for which was proposed by French writers: the Goncourt brothers and Émile Zola. Naturalists draw their personage concept from the interpretation of its biological nature. The focus of its depiction is shifted to the study of fundamental features of human nature rather than “variables” of the historical forms of its manifestation. A naturalistic character, being “a biological being” rather than “a set of social relations,” is completely absorbed (...) by the environment. The “social” core of a realistic personage is based on the principles of typification, but the “biological” core of a naturalistic character cannot be a generalized type because in it the individual prevails over the typified. Images of Germinie Lacerteux and Thérèse Raquin from the Goncourts’ and Zola’s same-name novels respectively are considered to be prototypes of naturalistic characters. In Ukrainian literature, Ivan Franko interpreted and synthesized Western European experience using realistic and naturalistic art to create his own concept of “scientific realism.” The difference in Franko’s personage construction lies in the fact that he does not confine himself to the observation and description of his heroes’ behavior but offers a plan for correcting their deficiencies. The article examines individual German translations of works by Lesia Ukrainka in various genres, which activate the concept of “struggle.” To establish the linguistic and stylistic analogues, coincidences, and diff erences of the translated works, their typological comparison with the original Ukrainian sources was carried out. It was found that key motifs in the works of Lesia Ukrainka, such as aff ection, resilience, courage, confrontation, and great strength of will and spirit are factors that form the concept of “struggle.” The (...) conceptual meanings and axiological values of the concept of “struggle” created by the poetess are: internal strength and independence; free choice, freedom, and liberty; the desire to have freedom and longing for it as the beginning or continuation of the struggle, a sign of insubordination, the spirit of disobedience; the word as a future weapon for the native language and Ukraine; the desire to prevail; the antithesis of death, sad thoughts, obedience, and others. The analysis revealed that there are some linguistic and stylistic diff erences in the analyzed German translations that are related to the peculiarities of German grammar and word formation. The selection of German equivalents sometimes further reinforces the emphasis of the original text. The concept of “struggle” in Lesia Ukrainka’s works in the analyzed translations into German by well-known translators fully reveals the conceptual picture of the author’s works and expands the possibilities of the reception of Ukrainian linguistic culture for German-speaking readers. The main purpose of the article is to highlight the content and logic of formation the concepts of the state that emerged among the Ukrainian Orthodox intellectuals in the end of XVI - early XVII century. During this period was decisive for the formation of early modern Ukrainian nation as a new community and the beginning of its struggle for statehood. Major political role in the formation of Ukrainian nation at that time played Cossacks, but the Orthodox clergy not only (...) gave ideological support Cossack, but had his own concept of nation. As the main creators of the concept were Meletius Smotrytsky, Zachariy Kopystensky, Jov Boretskiy, Petro Mohyla. His complete registration it has acquired at the time of the restoration of Orthodox Metropolis of Kyiv and the metropolitan of Petro Mohyla (1620-1646). The principal features of this concept is defined as follows: State Orthodox intellectuals understood as a voluntary association of people of all classes around one idea. This idea was determined public good that church leaders perceived primarily as a transcendent grace. The symbol of grace was heavenly Jerusalem, which advocated earthly projection Kyiv. Orthodox church leaders deliberately refused confession from the ideal state for aggressive ideal spiritual state. This identified a fundamental difference from the then existing state ideologies of the Rzeczpospolita and Moskovia. Ruler of the concept of the ideal state is determined Orthodox hierarchs not a person but a state, personified in its most charismatic spokespersons. At first, the prince, then the gentry, then the Cossacks. The main objective is the defense of the state governor and care about the welfare of his subjects. At the same time Ukrainian clerics fundamentally alien to the idea of autocracy, they differ greatly from contemporary Moscow clergy. Another important feature of the state concept Ukrainian Orthodox Church of the Cossack era is persistent assertion priority of the spiritual over the secular government that does not coincide with the ideals of the Cossacks and was often a source of conflict. The main conclusions of the note is the fundamental notions of state formation in the Ukrainian Orthodox Church, the difference between these concepts from Moscow-Byzantine ideology and proximity to European humanistic model of the state than is largely due to the role of the Orthodox Church in the national liberation revolution led by Bohdan Khmelnytsky and conflicts Kyiv Metropolis with the Moscow Patriarchate in the future. The article describes theoretical views on the development of ethical consciousness in Ukrainian university students in the context of postmodernism, using the data from quasi-experimental psycho-pedagogical measurements. The article aims to specify the process of developing structural components of ethical consciousness in Ukrainian university students, who de facto (culturally and socially) are still gaining the experience of late postmodernity. The following methods were used at the propaedeutic, quasi-experimental and resumptive levels: theoretical-methodological analysis of relevant scientific-methodical sources; selection of relevant diagnostic (...) methods; modelling of educational conditions; psychodiagnostic methods; methods of mathematical statistics; summarization. The necessary data were collected, with the observance of all ethical norms, at the premises of Ukrainian higher education institutions, with the participation of 280 students-respondents (Years 1-5) who major in the humanities and technology. The obtained results indicate a rather uneven personal development of students under all structural components of ethical consciousness. The main part of the article, as well as conclusions, clarifies the components of ethical consciousness, their dynamics and dependence on one’s worldview and experience. The international relevance of the article lies in objectifying ethical consciousness of young people in the post-totalitarian environment. It will allow one to evaluate the interaction between traditional and postmodern systems, justify the prospects of such categories as “meanings” and “values” in the belated postmodern society. The article is devoted to the study of the views of the Metropolitan of Kiev Sylvester Kosov on the essence, structure and function of the ideal state. An attempt was made to determine how these views influenced the formation of the self-identification of the Ukrainian ethnos during its design in the early modern nation. It was found out that the state concept of S. Kosov was formed on the basis of scientific achievements of the scientific community of P. Mogila and (...) was influenced by the Polish political ideology of the end of XVI - beginning of the XVII century. It is determined, that the nearest analogies particular concept had in the works of A. Kallonofyskiy and C. Copistensky. It is argued that one of the achievements of S. Kosov is the formulation of the ideologue of Kiev as the Second Jerusalem, which justified the political right to the sovereignty of the Ukrainian state. The political nation of that state considered to be the "people of Rus" as an ethnic community sharing the values of the baptism of Rus prince Volodymyr. The ruling elite of the ideal Ukrainian state considered the Orthodox gentry to be the metropolitan, and some of the functions of management recognized the Cossacks. The ideal ruler in the theory of S. Kosov was the "king-philosopher", endowed with wisdom and moral virtues. It was found out that S. Kosov one of the first introduced in the structure of self-identification of the Ukrainian nation the category of "antiquities" as the historical duration of the people, state and political elite. S. Kosov's views had a serious impact on the formation of the self-awareness of the early modern Ukrainian nation and were partially implemented in the political activities of B. Khmelnytsky. However, there was a significant divergence between the ideology of the Orthodox clergy and the Cossacks, which became heightened later in the times of the Ruins. (shrink)

The article describes evolutionary process of the ideas about the state, which were formed by Ukrainian Orthodox intellectuals in the end of the XVI - the first half of the XVII century. Established, that on the development of these ideas had considerable influenced political circumstances of Ukrainian Cossack state in the second half of the XVII century. Varied Nation orientations available in Ukrainian political elite caused at that time the political split of Ukrainian society which reflected on the church life. (...) Some part of Church leaders tended to association with the Polish-Lithuanian Commonwealth and the convergence with the Greek Catholic Church, the rest were supporters of political union with Moscow and rapprochement with Moscow Orthodoxy. However, both groups of Ukrainian Orthodox intellectuals defended the independence of the Kyiv Metropolis. Accordingly, representatives of both political orientations in church circles had their own opinion on the nature of the state, the governor responsibilities, composition of nation and its political rights, the relationship between the secular and ecclesiastical authority in the ideal state. Two outstanding representatives of these viewpoints were Sofonovych F. and I. Gisel. There are many ways where their views are identical, so: both agreed about the priority of ecclesiastical authority over secular, Kyiv's role as a center of Orthodox state, about the existence of a sovereign Ukrainian nation as an ethnic and religious communities. However, they also had fundamental differences: in F. Sofonovych's "Chronicle" sense of the state's existence and first responsibility of the governor was to ensure the public good, the conception of political nation extends to the whole society, the governor is the monarch in the European sense, who should be accountable to his lieges. Instead of that in I. Gisela's "Synopsis" meaning of the state was described in citizens' association in a single church, the governor is autocrat that answers only to the face of God, as the political nation was described only a minor group of nobility and its features were limited. In that way, we can assume that the concept of state, represented in work by Sofonovych F. indicates the beginning of the transition from early modern to modern Ukrainian nation and the continuation of the idea of Ukrainian sovereignty. Theory by Gisela I., whereas, the initial point of departure of Enlightenment concept of absolutism, which later was developed by Prokopovich F., and embodies the idea of an Orthodox empire which in the political sense coincides with the Russian Empire and in the spiritual one - is a continuation of Kievan Rus, where Kiev clergy plays a significant role. Both concepts were actively developing in future and had some mutual influence; also they greatly influenced the political life. (shrink)

The article examines the national worldview codes as a prerequisite for national revival. The urgency of studying world outlook codes in modern Ukraine is primarily due to the actualization of powerful manipulative anti-Ukrainian processes that often take the form of “hybrid wars”. The purpose of the article is to show how and based on what principles the main national world outlook codes function during important historical transformations. For this purpose, the article investigates two information and cultural fields, which are based (...) on world-view structures of the mythological type – national and imperial myths. These structures have their branched code systems, which are updated and described in the form of mythology, symbols and signs. Two important issues are additionally considered: encoding information through the codes of other systems and the use of different languages for transmitting the message, which may cause its distortion. The components of Ukraine’s image as the main mythological image with the national code base are analyzed. Much attention is paid to describing the basic code in the national unconscious of the Ukrainian people and its differences from the imperial view of the world. The historical retrospective is depicted on the example of the “Cossack era”, the activities of the “Central Council”, the “Time of Independence”, the “Orange Revolution – 2004”, the “Dignity Revolution – 2013–2014”, military operations in the ATO-zone, etc. Modern examples show the influence of actualization of relevant world outlook codes on political, social, and cultural life. The mechanisms of combining and enhancing world outlook codes, actualized in various spheres – politics, religion, culture, in particular, mass culture, social life – are discussed. The author also considers the distribution of influence of these codes on other areas of life for describing the surrounding world by ordinary citizens. The idea of three waves of national revival in modern Ukraine is proposed. Attention is drawn to the possible risks of ceasing the nation-building processes in the present, as well as numerous perspectives should this “wave” be as productive as possible. (shrink)

The existing among scientists convention in terms of rather free use of the term "communication" has a number of warnings. They are connected with a great difficulty and diversity of human interaction processes. This article deals with the consideration of scientific, philosophical and theological connotations of the concept "communication". Some basic attributes of this phenomenon and the assignment of communication to perform mainly its information and representative functions with respect to its participants have been considered. The existing attempts to bring (...) up to date not only informational, but also existential contexts of this phenomenon in the scientific discourse and communicative philosophy determine the necessity of relative concepts consideration: dialogue, interrelations, communication. The starting point of communication is a common interest. Having an information component as basic, communication cannot be reduced to it only. It is supposed to have an emotional exchange between people, to have not only the result, but also a process and contextuality. Any intercourse is exceptionally considered in a unity with activity and relationships. Concerning the correlation of the concepts "communication" and "dialogue", it is worth mentioning that although these words are quite often used as synonyms, it is evident that not every communication is a dialogue, and accordingly, not every dialogue is under the dominant of communication. In a dialogue with another man mostly the subjective being is brought into the foreground. Dialogicity is characterized by a special relation of Other presence, development of interrelations, enriched with a lot of meanings: ontological, existential, and ethical. The denial of monologicality and also so-called manadologicality of a human personality, which constitutes the role of interrelations for the human personality's being, is mostly cleared up through the concept of intersubjectivity. Under such conditions subjectivity in all complexity of relations to its constituting world, also appears as the result of co-being with other people. The theological synonym of the concept "intersubjectivity" is the concept of "perichoresis", which is usually used in the same context, but exclusively in relation to a transcendental being - interpenetration of the hypostases of the Divine Trinity. The article highlights the impact of globalization processes on formation of dominant worldviews and guidelines, as well as ways and means of representing the latter. The state and prospects of studying intertextuality as an important element of modern world discourses in the projection on the national cultural background are studied. Attention is drawn to the high degree of development of both theoretical and applied aspects of intertextuality of discourses by representatives of academic communities of different countries and fields of knowledge, (...) which gave grounds to establish the polydiscursive and interdiscursive nature of the object of analysis. Orientation of domestic experts on parameterization of mainly specific manifestations of intertextuality within certain discourses at the level of isolated intertexts and presence of gaps in the theoretical description of the phenomenon in the context of national specificity is stated. Emphasis is placed on the definite variability of the terminology due to the interdisciplinary nature of discursiveness and, accordingly, intertextuality. A complementary link has been established between postmodernism as the dominant philosophical worldview and the intertextuality of discourses. The specifics of the intertextuality of contemporary Ukrainian literary discourse with regard to various scientific studies are clarified. The concept of “intertextual memory” is introduced and justification of its use is given. The need to apply the term “postmodern intertextuality” in relation to contemporary literary discourse is considered. The common and distinctive features of the manifestation of intertextuality in literary and journalistic discourses are traced. The specifics of intertextuality of Ukrainian journalistic discourse are described. It is established that the precedent character of the communicative act is of exceptional importance for realization of intertextuality in journalistic discourse. (shrink)

Its aim is to do research in such areas as philosophy, culture, and religion of the countries of the Middle and Far East. The leading type of the circle’s work is the lectures made by specialists in Oriental studies, philosophers, representatives of various religious traditions, and travelers.

In the article are highlighted features of the receptions of marxism in chinese philosophy. Currently, the study of reception is one of the productive directions of the modern history of philosophy, because it allows you to gain knowledge about the philosophical culture and philosophical tradition of China, as well as to find out when the birth of marxism in chinese philosophy took place. The main goals the article is reconstruction a way of describing the emergence of marxism in chinese philosophical (...) thought, reproduction of the theoretical model of the main stages of its development; to explanation the keys problems, to which the attention of chinese philosophers was directed, from the standpoint of soviet and modern researchers; a description of the main figures who laid the foundations for the birth of marxism in chinese philosophy. In the result of investigation, on the basis of theoretical and methodological guidelines and requirements of scientific analysis and theoretical reconstruction, the main post-soviet narratives of the genesis of marxist-leninist philosophy in china were systematized, as well as an assessment of their theoretical, methodological and ideological attributes. The article is devoted to topical issues of the culture of professional speech of representatives of the field of law, the level of which is an indicator of professionalism and general culture of the specialist in today's conditions. The purpose of the article is a comprehensive review of speech culture in the professional activities of lawyers at the present stage of development of Ukraine. In the research process, a descriptive method was used, as well as linguistic observation. The content of (...) the concepts of “culture of speech”, “culture of speech”, “culture of professional speech”, “culture of professional speech of a jurist” is highlighted and delimited, and it is also determined that they are in a logical mutual dependence and interdependence. It is revealed that the main standards in the speech activity of a lawyer are correctness, accuracy, logic, clarity, purity, conciseness and expediency, where normativity plays a key role. The studied material demonstrates typical mistakes of irregularity of language norms in professional speech. The causes of these mistakes are identified and ways to eliminate them are named. After analyzing the importance of language literacy and noting the importance of increasing its level for perfect mastery of the Ukrainian language standards and application in practice, it is emphasized that the culture of professional literacy today is the key to the success of a professional personality of a lawyer. This article aims to define natural human rights in the context of forming postmodern views on an individual today. Natural rights exist, regardless of whether they are enshrined somewhere or not: they are clear from the natural context and essence of human activity. The postmodern world is experiencing a crisis of fatigue from life, fatigue of culture, which for the global world has become a political and economic crisis of ineffectiveness of the policy of multi-culturalism and poly-culturalism and the growing (...) dangers and threats associated with it. Therefore, it is crucial to find out how natural human rights are realized in postmodern society. Importantly, the article analyzes the basic theoretical and methodical principles of creating the postmodern environment and its impact on people. It also defines the main concepts and categories of human rights in the context of evolution of postmodern society. To study the socio-cultural impact on personality development in the postmodern era, the article explores how legal culture is formed in the course of civilizational-evolutionary development of society. Research methods are as follows: analytical methods, descriptive and explanatory methods, synthesis and analysis. The obtained results prove that natural human rights manifest the evolution of cultural progress and prospects for further analysis of their socio-cultural effects on the development of postmodern society. Exploring the history of our experience, Hannah Arendt reveals not only a radical transformation of its structure, but also the loss of experience as such and its replacement with technology. In order to identify the place of law in this process, we are trying to clarify the legal aspect of experience in terms of phenomenological hermeneutics and to trace its transformation in the digital age. The experience of law is thought of as one of the aspects of our mode of (...) being-in-the-world, which is based on openness to the world and consists in the mutual recognition of people in their dignity. Digital technologies, in turn, contribute to replacing fundamental openness with illusory freedom in cyberspace. The latter, unlike the public realm as a realm of action of many, and in this sense legal realm, is based primarily on productive activities of one and no longer requires law. (shrink)

Social responsibility as an awareness of the responsible attitude of the subjects (person, group, community, organization, state, society) to themselves and other subjects of this phenomenon and process is the basis for implementing Sustainable Development Goals. It permeates the entire structure of society both vertically (society – communities – person; state – region – citizen; economy – organization/enterprise (employer) – employee) and horizontally (society – states – economy; communities – regions – organizations/enterprises (employers); person – citizen – employee). The formation (...) of social responsibility is necessary for implementing Sustainable Development Goals and, at the same time, is its basis. The COVID-19 pandemic accelerated the formation and development of the phenomenon of social responsibility as a basis for the implementation of the goals of sustainable development, encouraging new actors of this phenomenon to act, creating conditions for the public (planetary) association to fight COVID-19; changed approaches to the economy, ecology, social sphere, education, etc. These changes can no longer be reversed, and society can only use them as a basis for further implementation of sustainable development goals. The present paper addresses the issue of determining the best international practices for developing soft skills among students of different specialties through carrying out a theoretical review. Basing on literature on present-day theory the authors make an attempt to explain soft skills dichotomies, summarize existing approaches to classifying soft skills, consolidate and document best international practices for soft skills development among potential employees of different specialties including bachelor students, master students, doctoral and postdoctoral students. The data obtained in the theoretical (...) analysis reveal that the possible ambiguities in the interpretation of the concept of “soft skills” are caused, on the one hand, by the dichotomic perception of their nature by present-day researchers and educators and, on the other hand, by the absence of the common language which makes it difficult to provide a more unified definition most satisfactory to all concerned. The authors are convinced that soft skills have a cross-cutting nature and regard them as personal and interpersonal meta-qualities and meta-abilities that are vital to any potential employee who is going to make positive contributions not only to his/her professional development but to the development of a company he/she is going to work for. The results of the conducted theoretical review clearly indicate that the absence of the unified understanding of the concept of “soft skills” is reflected in the existence of different approaches to classifying soft skills, let alone, the selection of didactic tools for developing soft skills among potential employees. The article analyses the problems and possibilities of forming a general methodological paradigm for the study, explanation and forecasting of social processes – in the context of the philosophical concepts of G. Hegel and F. Nietzsche. In particular, a fundamental possibility for forming a general methodological paradigm based on a dynamic balance of not optimal, but possible is analysed. The paper outlines the positive and negative aspects of the methodological paradigms of rationalism and irrationalism (postmodernism); points out the possibility of (...) terminological discourse in determining the content of concepts and categories; emphasises the efficiency of the methodological paradigm of rationalism on the example of the analysis and implementation of the philosophical category ‘measure’; substantiates the need for improvement of the spiritual priorities of various groups of the population – with a special emphasis on the layer of politicians. In the current research, using methods of oral history of philosophy, oral communication (in particular, interviews) is considered only as a technical phase in preparing the final text. The author claims that the primary audio or video recordings of such an interview, an "oral draft," should be considered independent material. After all, the written text does not reflect the interlocutors' intonations; comparing the source material and the final text may become important for future researchers. After the transcribed and agreed text (...) of the interview took its final shape, it should be analyzed by the interlocutors and supplemented with a commentary. This commentary aims to (1) clarify vague points of the text and (2) record the further opinions of the interviewer and interviewee. Therefore, the purpose of an interview that uses an oral history of philosophy should be an audio/video recording, a final text, and a commentary. (shrink)

The article focuses on the problem of development of the lifelong learning skills of senior students in secondary school of general education. The model of interaction between the subjects of learning in the Trello project management system is developed. The foreign literature learning environment in the Trello system is developed. The experience of using the Trello project management system in the process of teaching foreign literature in 10th and 11th grades is described. It has been found that according to the (...) lifelong learning approach a person has to possess skills: goal setting, self-regulation, motivation, time management, self-directed learning, collaboration skills, and self-development. It was pointed out that there are common approaches to project management and educational process management. The use of online systems for collaborative work in the educational process in the secondary school of general education is suggested. Online systems for teamwork that support Kanban methodologies for project management have been analyzed. To confirm the effectiveness of the implementation of the Trello project management system as a tool for the development of lifelong learning skills of senior students, an experiment was conducted: criteria, indicators, levels, and the state of formation of lifelong learning skills of senior students were determined; statistical analysis of the results of the experiment was carried out. The effectiveness of the implementation of the Trello project management system as a tool of the formation of the lifelong learning skills of senior students has been experimentally proven. The study can be applied in educational institutions interested in using agile methods in teaching. (shrink)

The urgency of the issue in question lies in the need to improve anti-discrimination legislation in Ukraine. The article aims to summarize the current state of combating discrimination in sports. Research methods include analysis, generalization, and the formal-logical method. The article summarizes international acts that promote the prohibition of discrimination and the need to combat it. One of the main problems in world sport is racial discrimination, and there are three types of racism in sports. The main disadvantage of laws (...) that lead to imperfect prosecution mechanism is entirely criminal liability for discrimination, even though the law on preventing and combating discrimination also implies administrative and civil liability. The article analyzes some positive foreign experience in combating and counteracting in sports. It shows that the priority areas for combating and counteracting discrimination in sports in Ukraine should be: improving the legislation in terms of prosecution; establishing a special body responsible for combating and counteracting discrimination in sports; introducing educational tools in schools and among members of sports organizations that promote human rights, regardless of race, colour or other characteristics. Emphasis is placed on the fact that an effective mechanism of legal regulation together with preventive measures should guarantee the protection of the rights of both athletes and fans. The obtained results can serve as the basis of legislative proposals to improve the fight against discrimination in sports, which will ensure the protection of human rights. (shrink)

Among the main professionally significant qualities of an education manager are such as strategic thinking, readiness for self-development, ability to make operational decisions, special and general abilities, positive motivation of professional activity, cross-cultural competence, emotional intelligence and cognitive empathy, effective time management. In a competitive environment, stable positions are occupied by enterprises that are able to form a balanced development program, effectively maneuvering the internal factors of competitiveness and adapting to the conditions of external factors. It is noted that innovative development affects both external and internal factors of competitiveness. External factors of competitiveness under the influence of innovative development tend to improve the conditions for entrepreneurs. The author stands that thinking by analogy is a natural instrument human have because of the mirror neurons in our brain. However, is it that infallible to rely on? How can we be sure that our hidden biases will not harm our reflections? Implicit Association Bias (IAB), for instance, is a powerful intruder that affects our understanding, actions, and decisions on the unconscious level by cherishing the stereotypes based on specific characteristics such as ethnicity, sex, race, and so on. To (...) check if there is a correlation between the IAB effect and the people’s capacity to reason logically, the author had created an online-survey. The purpose of this article is research of various aspects of imitation modeling as effective method of the analysis and optimization of the pricing process on the tourist enterprise. In article the methodology of imitation modeling of the pricing process for a tourist product is investigated. For formation and realization of model of pricing it is offered to use imitation modeling which allows to receive the expected size of the price under various operating conditions of the tourist enterprise. It is (...) shown that imitation modeling of economic process contains 7 main stages: the formulation of a problem and definition targets than imitation research; development of conceptual model of the modeling object, formalization of the imitation model, choice of software and control of the imitation model; complex testing of the model; planning and implementation of imitation experiment; analysis of results of modeling. The main purpose of imitation model consists in adjustment of level of the price depending on influence of pricing factors. In article the main advantages of the imitation modeling in comparison with other methods of modeling are marked out. Imitation modeling considers influence of a large number of uncertain factors, which cannot be precisely described by means of analytical models. The methodology of the imitation modeling allows to analysis expensive and not expensive elements of the price of a tourist product. Imitation modeling allows estimating efficiency and productivity of the prices of new level until their introduction at real process. The imitation model allows investigating system of pricing in dynamics and allows change of its functioning at any stage of modeling. It is possible to implementation new variables and conditions into model, to replace values of factors and so forth. The imitation model of pricing process allows uniting models of separate subsystems in one complex model, which considers influence of separate subsystems on behavior of the whole system. Based on the conducted researches advantage of a method of the imitation modeling to optimization of management of the pricing process at the tourist enterprise is proved. (shrink)

The current global crisis caused by the coronavirus pandemic has already become a challenge for individual national economies, as well as the global world system as a whole. The eminent English historian Toynbee wrote that the viability of a civilization depends on the extent to which its elite can mobilize its intellectual, moral, and physical strength to respond adequately to the challenges. Therefore, challenges are necessary for humanity since without them one would deal with spiritual and intellectual stagnation. Indeed, that (...) which does not kill us makes us stronger. This aphorism becomes especially relevant in present times when the world is concerned with what the “post-covid” world will be, what transformations the values and worldview of individuals will undergo. The coronavirus pandemic acts in this case as a catalyst and accelerator for change and forces one to pay attention to them. As Toffler once pointed out, “The inhabitants of the earth are divided not only by race, nation, religion or ideology, but also, in a sense, by their position in time”. The future is rapidly coming, although only a few per cent of the entire human population “live” in the future, that is, are psychologically ready for it. The vast majority of people live with old ideas, stereotypes, and norms of past generations. This does not mean that one should break “the link of times” and recklessly erase the historical past. The COVID-19 pandemic, which spread around the world in 2020, changed the lives of millions of people and affected the life and functioning of all countries and people without exception. With the emergence of the opportunity to be vaccinated against COVID-19, the problem of making a decision about vaccination also appeared. But it has become increasingly clear that the coronavirus is moving into the group of annual viral epidemic diseases that occur every year in different countries during the seasonal wave (...) of acute respiratory viral infections. The ongoing COVID-19 pandemic against the background of the adoption of serious quarantine measures indicates the need for large-scale vaccination of the population as the most effective way to protect against COVID-19. In this article, we pay special attention to vaccination, as the main factor in ensuring health, reducing the morbidity and severity of the course of the COVID-19 disease, and an important task of the state and modern public administration. The article addresses organization of distance learning of foreign languages in quarantine during the postmodern era. It is noted that organization of distance learning in the educational process is very important. It was clarified that distance learning is based on synchronous and asynchronous modes. The essence of the concepts of “distance learning”, “asynchronous learning”, “synchronous learning”, “quarantine” is explained. Articles of domestic and foreign teachers and scientists analysing the broached subject were reviewed. The article highlights advantages and disadvantages of distance (...) learning. It has been studied that for students studiing foreign languages remotely, an interesting form of learning is watching TV shows and movies. The digital programs and the essence of their advantages are also given. The researchers’ view on the effectiveness of multimedia presentations, trainings, games is given. It is also found that during the COVID-19 pandemic, it is hard for parents to work on the platforms unlike children. The platforms for synchronous and asynchronous learning are separated. It is noted that teachers with primary school students use visual forms of learning to interest children and to present new material in a clear and accessible way. During the COVID-19 pandemic, virtual communication is found prevaling in postmodern society. It is noted that a foreign language can be learned through a Facebook group. It is investigated that learning foreign languages requires special attention to development of communication skills. In the article, referring to the method of rational reconstruction described by R. Rorty, an analysis of some works of J. Locke has been made in order to identify new prospects in John Locke's philosophy researches. As a result, it’s been demonstrated the presence of silence as an argument and a manifestation of respect J. Locke’s research of realms of cognition, political philosophy and philosophy of education. This is not covered in modern John Locke's philosophy researches. The authors emphasize that (...) J. Locke, although not directly exploring silence as an argument, however, describes the argument ad ignorantiam, the wording of which in the work «An Essay Concerning Human Understanding» and his understanding of tacit consent in the work «Two Treatises of Government» are related to silence as an argument and a manifestation of respect. The position that silence as an argument is present in all four arguments (argumentum ad verecundiam, argumentum ad ignorantiam, argumentum ad hominem, argumentum ad judicium) described by J. Locke is substantiated. Additionally, the argument ad ignorantiam can be considered both as an argument from silence (ex silentio argument) and as a kind of argument to silence. Considered arguments can serve as an argument to silence for the proponent and/or the third party, that is, anyone who is not directly involved in the dispute. Basing on J. Locke's explanation of the characteristic feature of tacit consent, that is, the absence of the expressed consent/disagreement, the possibility of distinguishing the indirect connection between tacit consent and the argument ad ignorantiam is demonstrated, since both tacit consent and the argument ad ignorantiam in J. Locke's works rely on the absence of expressed statements on the consent or disagreement of the opponent. It is established that the ideas of the education of children described by J. Locke also correlate with silence as an argument and a manifestation of respect. Applying the classification of the types of respect proposed by S. Hudson and complemented by R. Dillon to the use of the term «respect» to the various texts of J. Locke, it is substantiated that described by him respect covered almost all kinds of this classification. (shrink)

The paper aims to give a comprehensive cognitive and semiotic analysis of translation strategies implied in the translation of the film “Darkest Hour”. Regarding a film as a communicative process mediated by certain semiotic features makes it possible to analyze the semiotic character of film discourse in translation. Thus, it was decided that translation is not just a speech-oriented process but a communicative act taking place within a definite semiotic space in a cross-cultural perspective. The semiotic model of cinematic discourse (...) has a complicated structure and is analyzed based on semantic, syntactic, and pragmatic criteria. The choice of the semiotic system primarily depends on the communicative situation and its recipients. As the semiotic system of the film “Darkest Hour” is both socioculturally and situationally conditioned, the translator reconstructed the sense of the source language text by implying the translation transformations that assured the accuracy and adequacy of its translation into the target language text.
